1. About These Terms

This Cookie Policy explains how Vivatar Heathrow Hotel, operated by Vivatar Hotels Limited (“Vivatar”, “we”, “us” or “our”), uses cookies and similar technologies when you visit our website.

For the purposes of this policy, “cookies and similar technologies” includes cookies as well as other technologies that store information on, or access information from, your device. This can include technologies such as pixels, scripts, tags, web storage and similar technologies.

Our use of these technologies is governed by applicable UK privacy and data protection law, including the Privacy and Electronic Communications Regulations 2003 (PECR) and, where personal data is processed, the UK GDPR and Data Protection Act 2018.

PECR requires us to provide clear information about the storage and access technologies we use and, unless an exception applies, obtain consent before using them.

This Cookie Policy should be read alongside our Privacy Policy, which explains more generally how we collect, use and protect personal information. Vivatar Hotels Limited is the controller of any personal data processed through cookies and similar technologies described in this policy, as further explained in our Privacy Policy.

2. What Are Cookies and Similar Technologies?

Cookies are small text files that a website may place on your computer, smartphone, tablet or other device.

They can allow a website to operate correctly, maintain security, remember preferences, provide functionality, understand how visitors use the website and improve website performance.

The rules also apply to technologies other than traditional cookies where they store information on, or access information from, your device. These can include tracking pixels, web storage, scripts, tags, link-decoration technologies and other similar technologies.

3. The Cookies and Technologies We Use

CookiesPolicy.png

Important note: The exact cookie names, providers, durations and technologies operating on the website may change as Wix, Google Analytics, MEWS and other services are updated.

A technology must not be classified as strictly necessary merely because it is supplied by Wix, Google, MEWS or another provider. The classification depends on its actual purpose and whether the relevant PECR exception applies.

4. Strictly Necessary Technologies

Some cookies or similar technologies are necessary for the operation of the website or for a service that you have specifically requested.

Examples may include technologies required for website security, technical operation, session management, network communication, essential website functionality and the operation of a booking service requested by you.

Where a technology falls within the applicable PECR exception for a strictly necessary service, consent is not required. The exemption is limited and does not apply simply because a technology is convenient or beneficial to the website operator.

5. Functional and Preference Technologies

We may use functional or preference technologies to improve your experience of the website, for example by remembering preferences or enabling additional functionality.

Where these technologies are not covered by a PECR exception, we will obtain your consent before using them. If you choose not to accept these technologies, some website features (for example, certain preference or personalisation features, and in some cases parts of the booking journey) may not function as intended. We are not responsible for any resulting reduction in website functionality, except to the extent required by applicable law.

6. Google Analytics

We use Google Analytics to help us understand how visitors use our website.

Analytics may provide information about pages visited, how visitors navigate the website, traffic sources, approximate geographic information, device and browser information, interactions with website content and general website performance.

Google Analytics is an analytics technology rather than a strictly necessary technology. Accordingly, the relevant Google Analytics cookies or similar technologies must not be activated before the visitor has provided the required consent.

We will not treat simply continuing to browse the website as consent. Where technically available, we configure Google Analytics to minimise the personal data it collects, for example through IP anonymisation or similar privacy-preserving settings.

7. Wix

Our website is hosted and operated using Wix. Wix may use cookies and similar technologies for essential website functionality, security, technical operation, performance, preferences and additional functionality.

The exact technologies used by Wix may change over time. Vivatar will ensure that technologies used through Wix are appropriately categorised and that any required consent is obtained before non-exempt technologies are activated.

8. MEWS and the Hotel Booking Process

Our website may connect visitors to our hotel booking system operated through MEWS.

When you choose to make a booking, you may be transferred to, or interact with, a MEWS booking interface.

Technologies used by the booking interface may be necessary for the booking service you have requested. Other technologies used by the booking interface may not be strictly necessary. The actual technologies used by MEWS must therefore be reviewed and categorised according to their individual purposes.

Information about the processing of personal information associated with your reservation is provided in our Privacy Policy.

9. Future Technologies

As our website develops, we may introduce additional analytics, performance, security, functionality, marketing, advertising or other storage and access technologies.

Before introducing a new non-exempt technology, we will assess what information it stores or accesses, its purpose, provider, duration, whether personal data is involved, whether consent is required, whether it is first- or third-party, and what information must be provided to visitors.

Where consent is required, the technology must not be activated until the appropriate consent has been obtained.

10. Cookie Consent

Where consent is required, we will ask for consent before using the relevant cookie or similar technology.

Where applicable, visitors will be able to accept non-essential cookies, reject non-essential cookies and manage their preferences by category.

Consent will be obtained through a clear affirmative action.

We will not rely on continued browsing, scrolling, inactivity, pre-ticked boxes or a statement that cookies are accepted simply by using the website as a substitute for valid consent where consent is required. While we take reasonable steps to ensure our cookie consent tool operates correctly, we do not guarantee that it will operate without interruption or technical error at all times, and we are not liable for minor or non-material inconvenience arising from a temporary technical fault, to the extent permitted by law.

11. No Pre-Loading of Non-Essential Technologies

Non-essential cookies and similar technologies must not be loaded before the required consent has been obtained.

This applies to technologies used for analytics, advertising, remarketing, behavioural tracking and other non-essential purposes.

The website consent mechanism must be technically integrated with the relevant technologies.

12. Managing and Withdrawing Your Consent

You can change or withdraw your cookie preferences at any time using the cookie settings provided on our website.

Where appropriate, the website will provide an accessible mechanism for revisiting your choices. You may also control cookies through your browser settings.

Withdrawing consent does not affect processing that took place before consent was withdrawn. Where technically possible, withdrawal will prevent future use of the relevant non-essential technologies.

Consent must be as easy to withdraw as it was to give.

13. Cookie Consent Records

Where we rely on consent, we will maintain appropriate records demonstrating that consent was obtained.

These records may include the date and time of consent, the categories consented to, the relevant consent mechanism or version and, where technically available, information necessary to demonstrate the consent associated with the device or browser. We will periodically invite visitors to reconfirm their cookie preferences (for example, approximately every 12 months), and will treat consent as no longer current after such a period, consistent with ICO guidance on the ongoing validity of consent.

14. Third-Party Technologies

Some technologies may be provided by third parties, including Wix, Google Analytics, MEWS, booking or distribution providers, analytics providers, embedded services and other technology providers introduced in the future.

Where a third party stores or accesses information on a visitor’s device, or processes information obtained through such technology, we will provide appropriate information about the third party and its purpose.

Where a third party processes personal data on our behalf, we will put appropriate contractual and data-protection arrangements in place where required. Where a third-party provider acts as an independent controller of information collected through its own technology (for example, where a visitor interacts directly with an embedded third-party service), that provider is separately responsible for its own processing, and we encourage visitors to review the relevant third party's own privacy and cookie information.

15. First-Party and Third-Party Technologies

A first-party cookie or technology is generally set or operated by the website you are visiting. A third-party technology is generally operated by another provider.

Third-party technologies may be used to provide services such as analytics, booking functionality or other website features.

We will periodically review whether technologies are first-party or third-party and update this policy where necessary.

16. Cookie Duration

Session technologies generally expire when the browsing session ends. Persistent technologies remain for a defined period or until they are deleted.

The duration of each technology depends on its provider and purpose. Vivatar will periodically review cookie durations and consider whether they remain appropriate for the purpose for which the technology is used.

17. Personal Data

Not every cookie or similar technology involves personal data. However, information obtained through these technologies may constitute personal data where it can be linked, directly or indirectly, to an identifiable individual.

Where personal data is processed, the UK GDPR and Data Protection Act 2018 may apply in addition to PECR.

Our Privacy Policy explains how Vivatar processes personal information more generally.

18. International Transfers

Some technology providers may process information outside the United Kingdom.

Where UK data protection law applies to such processing, Vivatar will take appropriate steps to ensure that any international transfer is lawful and that appropriate safeguards are in place.

Further information is provided in our Privacy Policy.

19. Browser Controls

Most browsers allow you to view, delete, block or restrict cookies, or receive warnings when cookies are being placed.

Browser controls can provide an additional means of managing cookies. However, browser settings do not necessarily provide the same level of granular choice or consent records as our website’s cookie-consent mechanism.

20. Keeping This Policy Accurate

The technologies used by websites can change. Vivatar will periodically review the technologies operating on the website and update this Cookie Policy where appropriate.

A review should consider the actual technologies present, cookie names, providers, purposes, first- or third-party status, duration, whether personal data is processed, whether consent is required and whether the website’s consent mechanism operates correctly.

The courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim.
